Terms of Service

2.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts. By using the Service, you represent that you meet these requirements.

2.2 Account Registration

• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access or security breach
• One person or legal entity per account
• You are responsible for all activities under your account

2.3 Acceptable Use

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit malware, viruses, or malicious code
• Use the Service for spam, phishing, or fraudulent activities
• Collect or harvest data from other users without permission
• Attempt to reverse engineer, hack, or compromise the Service
• Resell or redistribute the Service without authorization
• Use the Service to collect sensitive personal information without proper consent and security measures

3.1 Paid Plans

Certain features require a paid subscription. Pricing is displayed on our website and may change with 30 days' notice to existing subscribers.

3.2 Payment Terms

• Subscriptions are billed monthly or annually in advance
• Payments are processed via Razorpay or other authorized payment gateways
• All fees are in Indian Rupees (INR) unless otherwise stated
• You authorize recurring charges for subscription renewals
• Failed payments may result in service suspension or termination

3.3 Refunds

We offer a 7-day money-back guarantee for new subscriptions. After 7 days, all payments are non-refundable. Refunds are processed to the original payment method within 10 business days.

3.4 Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of the current billing period. No partial refunds are provided for unused time.

3.5 Plan Changes

Upgrades take effect immediately with prorated billing. Downgrades take effect at the next billing cycle. You are responsible for managing plan limits and ensuring compliance.

4.1 Your Data

You retain all ownership rights to your content, including forms, submissions, and files. We do not claim ownership of your data. You grant us a limited license to host, store, and process your data solely to provide the Service.

4.2 Data Security and Backup

We implement industry-standard security measures to protect your data. While we perform regular backups, you are responsible for maintaining your own backups. We are not liable for data loss due to your actions or third-party failures.

4.3 Data Portability

You may export your data at any time in standard formats (CSV, JSON). Upon account termination, you have 30 days to export your data before permanent deletion.

4.4 Respondent Data

You are responsible for complying with all applicable data protection laws regarding form respondent data. You must obtain necessary consents, provide privacy notices, and handle data lawfully.

5.1 Our Rights

The Service, including its software, design, features, trademarks, and content, is owned by Areneva and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

5.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms. This license terminates upon account termination or violation of Terms.

5.3 Feedback

Any feedback, suggestions, or ideas you provide become our property. We may use them without compensation or attribution.

6.1 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible. We are not liable for downtime, service interruptions, or data access delays.

6.2 Modifications

We may modify, update, or discontinue features at any time. We will provide notice of significant changes affecting functionality or pricing. Continued use after changes constitutes acceptance.

7.1 By You

You may terminate your account at any time through your dashboard or by contacting support. Termination does not entitle you to a refund.

7.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Fail to pay fees
• Pose a security risk to the Service or other users
• Remain inactive for over 12 months

7.3 Effect of Termination

Upon termination, your access ends immediately. You have 30 days to export your data. After 30 days, we may permanently delete your data. Fees paid are non-refundable upon termination.

10.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. The courts of Jammu, Jammu & Kashmir shall have exclusive jurisdiction.

10.2 Dispute Resolution

In the event of a dispute, you agree to first attempt to resolve it informally by contacting us. If unresolved within 30 days, disputes shall be resolved through binding arbitration in Jammu, Jammu & Kashmir, in accordance with the Arbitration and Conciliation Act, 1996.

11.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Areneva regarding the Service.

11.2 Amendments

We may update these Terms at any time. Significant changes will be notified via email or Service announcement. Continued use after changes constitutes acceptance.

11.3 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

11.4 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

11.5 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
